Terms and Conditions

Introduction

The Clusters website presents introductory and marketing information about the “Your Land and Your Investment” product to explain the proposed development model for landowners, including the basic steps, potential benefits, and the land study process. This content is general guidance only and does not constitute a contractual offer, commitment, or guarantee of any results or returns. It does not create any formal relationship between the landowner and Clusters except under final agreements signed by both parties.

First: Nature of Published Information

All information published about the product is introductory and non-binding. It does not constitute an offer, promise, or guarantee from Clusters, nor does it create any right or expectation for the landowner before the signing of written and signed agreements.

Second: Returns and Illustrative Examples

The website may include estimated return-of-investment percentages or examples. These are for illustrative purposes only and do not represent a commitment or guarantee of any return. The results may vary wholly or partially depending on the study, the nature of the land, the negotiations, and the final agreements. No published figures should be considered the basis for any claims to rights.

Third: Land Study and the Creation of Obligations

The submission of land data is subject to a preliminary study, without any obligation on the part of the communities to accept the land or enter into a contract regarding it. No formal, financial, or legal relationship arises between the landowner and the communities except by virtue of written and signed agreements. These agreements constitute the sole legal framework governing the relationship.

Fourth: White Land Fees

White land fees are subject to the provisions and regulations issued by the Ministry of Municipalities and Housing, pursuant to:

https://idlelands.momah.gov.sa/ar

The associations have no authority to impose, exempt, amend, or postpone the fees. Any mention of benefit or exemption is merely a description of the regulatory texts and does not constitute a promise or commitment from the associations. The associations’ role, when authorized by law and after the contract is signed, is limited to following up on applications with the competent authority without guaranteeing acceptance or the outcome.

Fifth: Legal Qualification of the Broker or Agent and Entitlement to a Commission

If a person fills out the form on behalf of the landowner, they must possess:
A valid power of attorney, or
• A legally valid real estate brokerage contract,
• A “Fal” real estate marketing license.

The broker’s submission of data or initial contact does not constitute entitlement to any commission, nor does it create any right for them against the associations or the landowner.

The commission is only due after the final development contract is signed, the commission percentage is agreed upon in writing, and the legal documents proving the broker’s status and representation of the landowner are in place.

The commission percentage mentioned in any marketing content is an estimate and not binding. The amount and entitlement to the commission are determined only in the final agreements.

Sixth: The Form’s Compliance with Real Estate Regulations

The proposed development form is subject to applicable regulations and bylaws. With:
